Trademark Information. Intel’s trademarks may be used publicly with permission only from Intel. Fair use of Intel’s trademarks in advertising and promotion of Intel products requires proper acknowledgement.

Permitted and Prohibited Uses. User may use the Intel Premier IT Professional web site for the sole purpose of allowing productivity professionals to share and exchange their ideas. User may not use the Intel Premier IT Professional web site to violate any applicable local, state, national, or international law, including without limitation any applicable laws relating to antitrust or other illegal trade or business practices, federal and state securities laws, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, and any U.S. laws, rules, and regulations governing the export and re-export of commodities or technical data. User may not upload or transmit any material that infringes or misappropriates any person’s copyright, patent, trademark, or trade secret, or disclose via the Intel Premier IT Professional web site any information the disclosure of which would constitute a violation of a confidentiality obligation on User’s part. User may not upload any viruses, worms, Trojan horses, or other forms of harmful computer code, nor subject the Intel Premier IT Professional web site’s network or servers to unreasonable traffic loads, or otherwise engage in conduct deemed disruptive to the ordinary operation of the Intel Premier IT Professional web site.
User Submissions. Any material, information or other communication User transmits or posts to the Intel Premier IT Professional web site will be considered non-confidential and non-proprietary (”Communications”). Intel will have no obligations with respect to the Communications.
Photography. By attending an Intel Premier IT Professional event, attendees agree to allow Intel to post photographs of them on the Intel Premier IT Professional website and use them in other Intel promotional materials. At the registration check-in for each event, attendees may request that pictures of themselves be excluded from these promotional and website uses.
User Discussion Forums. Intel may, but is not obligated to, monitor or review any areas on the Intel Premier IT Professional web sitewhere users transmit or post communications or communicate solely with each other, including but not limited to chat rooms, bulletin boards or other user forums, and the content of any such communications. Intel, however, will have no liability related to the content of any such communications, whether or not arising under the laws of copyright, libel, privacy, obscenity, or otherwise. Intel may edit or remove content on the Intel Premier IT Professional web site at its discretion at any time.
Intellectual Property Rights. User grants to Intel, Founding Members and other Users an unrestricted, irrevocable, fully-sublicenseable, fully paid, royalty-free license to use, make, reproduce, distribute, display, perform and modify all information or technology disclosed to the Intel Premier IT Professional program, and User further agrees that Intel, Founding Members and other Users are free to use any ideas or techniques embodied in such information or technology for any purpose. No express or implied intellectual property licenses are granted between Intel and User unless otherwise stated at the time of delivery of the materials.
Use of Personally Identifiable Information. Information submitted to Intel through forms on the Web site is governed according to the Electronic Personal Information Privacy Policy .
Indemnification. User agrees to indemnify and hold Intel and the Founding Members harmless from and against any and all damages, costs (including reasonable attorneys fees), losses, and liabilities incurred by Intel and Founding Members as a result of any third-party claims, actions, suits, or proceedings arising out of or relating to User’s use of ITshareNet or breach or alleged breach of these terms of use.
Termination of Access. Intel may terminate User’s access to the Intel Premier IT Professional web site at any time without notice. Intel reserves the right to block a User’s access to the Intel Premier IT Professional web site at any time.
WARRANTY DISCLAIMER. ITSHARENET AND ASSOCIATED MATERIALS ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF INTELLECTUAL PROPERTY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL INTEL BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE ITSHARENET, EVEN IF INTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Liability Limitation. In no event will Intel or the Founding Members be liable under any contract, negligence, strict liability, or other legal or equitable theory for any special, incidental, indirect, or consequential damages of any kind, including, without limitation, those resulting from interruption of use, loss or corruption of data, or lost profits, whether or not Intel has been advised of the possibility of such damage. Intel and the Founding Member’s total cumulative liability for any and all claims in connection with the Intel Premier IT Professional web site will not exceed twenty five thousand U.S. dollars ($25,000.00). User agrees and acknowledges that the foregoing limitations on liability are an essential basis of the bargain and that Intel and the Founding Members would not provide the Intel Premier IT Professional web site absent such limitation.
General. These Terms are governed in all respects by Delaware law, excluding Delaware’ s conflicts of laws provisions. The provisions of the UN Convention on Contracts for the International Sale of Goods will not apply to these Terms. A party may give notice to the other party only in writing at that party’s principal place of business, attention of that party’s principal legal officer, or at such other address or by such other method as the party shall specify in writing. Notice shall be deemed given upon personal delivery or, if sent by certified mail with postage prepaid, 3 days after the date of mailing. If any provision herein is held to be unenforceable, the remaining provisions will continue in full force without being affected in any way. Further, the parties agree to replace such unenforceable provision with an enforceable provision that most closely approximates the intent and economic effect of the unenforceable provision. Section headings are for reference purposes only and do not define, limit, construe or describe the scope or extent of such section. These Terms set forth the entire understanding and agreement of the parties, and supersedes any and all oral or written agreements or understandings between the parties, as to their subject matter. The waiver of a breach of any provision of this Agreement shall not be construed as a waiver of any other or subsequent breach.
Links to Other Materials. The linked sites are not under the control of Intel and Intel is not responsible for the content of any linked site or any link contained in a linked site. Intel reserves the right to terminate any link or linking program at any time. Intel does not endorse companies or products to which it links and reserves the right to note as such on its web pages. If you decide to access any of the third party sites linked to this Site, you do this entirely at your own risk.
Changes to Terms of Use. Intel may revise these Terms at any time by updating this posting.
